Mary Molloy Solicitors was established in 1981 and has been advising individuals, families and businesses across Ireland for more than four decades. This site is dedicated to our farm and agricultural law practice: the legal work of transferring, protecting and passing on Irish family farms.

Why Farming Families Instruct Us

Farm work is different from ordinary conveyancing or will drafting. A farm is a business, a home and often the product of several generations of work. The legal decisions — when to transfer, how to provide for the older generation, how to treat non-farming children, whether to lease or licence, how to structure a partnership — interact with reliefs, the Fair Deal Scheme and family relationships. Getting the sequence right matters as much as getting the documents right.

Our farm practice is led by Richard O’Shea, a solicitor and STEP-qualified Trust and Estate Practitioner (TEP). STEP is the international professional body for practitioners specialising in family inheritance and succession, and the TEP designation reflects examined expertise in exactly the work at the heart of farm succession: wills, trusts, estates and lifetime transfers. Richard also holds a Diploma in Mediation from the Law Society of Ireland, which is often valuable where succession involves difficult family conversations.

How We Work With Your Accountant

Mary Molloy Solicitors are solicitors, not tax advisors. On farm transfers we deliberately work as part of a team: your accountant or tax advisor determines the tax treatment and timing, and we prepare and complete the legal documents that implement the plan — deeds of transfer, wills, rights of residence, leases, partnership agreements and Land Registry applications. Many of our instructions come to us alongside, or on the recommendation of, the family’s accountant.

Our Offices

We practise from two offices: The Ormond Building, 31-36 Ormond Quay Upper, Dublin 7 (D07 EE37) and 2 Rose Inn Street, Kilkenny (R95 W58D). Between them, the offices place us within convenient reach of farming counties across Leinster and Munster, and we act for clients throughout Ireland — much of the work can be progressed by phone, email and post. Richard O’Shea TEP, Solicitor practises with Mary Molloy Solicitors (established 1981), advising farming families across Ireland on farm transfers, succession planning, wills, probate and agricultural property matters.
